In these terms and conditions, the following shall have these meaning

  • “Company” reference to “Our” “we” is a reference to Globalsend).
  • “Term” shall have the same meaning as provision.
  • “Service” means money transfer facility and transactional service offered by Globalsend.
  • “User” “Customer” “You” are used interchangeably to mean the person seeking our services.
  • “Halt” Means to suspend.
  • “Transaction” means the transmission or sending of funds using Global send platform.
  • “Apps” Means mobile application for the sending of payment request/transaction.
  • “Bank Cards” Means Visa /MasterCard Debit/Credit issued by a Bank, Building society in the United Kingdom.
  • “Cards” Means the card issuer and owner of the card.
  • “Sender” Means the person who is sending the money using global send platform.
  • “Beneficiary” Means the person identified as the receiver of the funds.

Globalsend Ltd allows its customers in the UK to send money worldwide, by providing electronic payment instruction Via our platform.

Payment is to be made by Bank transfer or Debit card. The Bank in the case of a Bank transfer may charge for this service. Any charge raised by the Bank for providing their service is a separate agreement with them respectively and does not affect the agreement as between the company and you the customer.

Funds will usually be available for collection by the beneficiary within minutes of your transaction being authorised or the funds transferred to us by you being received, this being subject to the opening days/hours and time zone difference of the pay-out destination. In some countries and for account credit mode it may take 3-5 working days.

Globalsend Ltd is a limited liability company registered in England and Wales. The Company is regulated by HM Revenue and Customs under the Money Laundering Regulations as a Money Service Business and by the Financial Conduct Authority (FCA) Payment Institution (No: 769342)

The Company shall provide the “Service” for the “Customer” in accordance with these Terms and Conditions and this shall constitute the entire agreement between the “customer”.

These Terms and Conditions apply to the use of the company’s website and to the provision of our services. The use of any of the service will constitute your express acceptance of our Terms and Conditions. Please read and understand these Terms and Conditions before you accept them. Failure to observe the Terms of Conditions of the Agreement with us has legal consequences.
The Company reserves the right to change the Terms and Conditions from time to time in which event notification of any change will be posted on our website in a clear and readily accessible manner. It shall be the duty of any “User” to properly acquaint themselves with the updated Terms and Conditions which shall at all times apply from the date of publication until deletion, substitution or amendment.

You understand that we are obliged to keep all information in our database for up to 5 years, as required by the authorities

Confidentiality/ Privacy

As a fully regulated institution and with a purpose of providing the Service we are bound by the legal requirements to obtain, verify and record information about our customers. Therefore we may request from you or consult any legal sources to obtain your personal data when offering the Service to you.

1. Your personal information will be treated and processed securely and strictly in accordance with applicable laws and regulations.
2. We will not treat customer information as confidential where it is already public knowledge or where it becomes public knowledge through no fault of our own.
3. We may disclose customer information if we are required to do so by law, by court order, by any statutory, legal or regulatory requirement, by the police or any other competent authorities in connection with the prevention or detection of crime or to help combat fraud, money laundering and terrorism financing. We may also report suspicious activity to appropriate competent law enforcement or government authorities.

Use of service

The company will use its best endeavours to process transactions promptly; however some transactions may be delayed or cancelled for a number of reasons including but not limited to our efforts to verify your identity, to validate your transaction instruction, to contact you, or to comply with applicable law or due to variations in business hours or currency availability. The company cannot be held liable for any delay, loss, interruptions or errors in transmission of payment.

Access to our service you must be over the age of 18 years to issue instructions through the website portal. Before accepting instructions from you we require evidence that you are of appropriate age and qualification.

The website contents may change without notice and the Company does not warrant or guarantee that either the website or its contents will be available all the time (see below).

The company may discontinue or modify the service or any part of it without notice and at any time.

Registration

In order to “Open an Account” on the Company Website Platform the “User” is required to complete an online Registration process in accordance with the instructions provided. Registration requires acceptance of the Company’s Terms and Conditions.
As part of the Registration process you will be provided with “log in” details and be required to select or be assigned a personal “password”. Once your Registration has been accepted you are obliged to ensure that any “log in” detail and or password, picked or allocated are treated with the strictest confidence and are in no circumstances to be divulged to any third party.

The Company will without any notification have the right to “Halt” any “User” and to remove their “Credentials” at any time if in the opinion of the Company; the “User” has breached any of these conditions or misused the system.

The email ID used requires being their personal email of the account holder only.

b) Provide us with any identity documentations as may be requested by us;
c) Provide us with details of one or more Payment Instruments;
d) Provide us with true, accurate, current and complete information is required to receive the Service and any other information which may be required in relation to the Recipient;
e) Any other information that must be provided for a Transaction Request to be properly executed, as specified when you enter the details of the Transaction you are interested in on our website; and

Password protection

You must take all reasonable steps to keep your Account password safe at all times and never disclose it to anyone. Our personnel will never ask you to provide your password to us or to a third party. It is advisable to change your password regularly (at least every three (3) to six (6) months) in order to reduce the risk of a security breach in relation to your. We also advise you not to choose a password that is easily guessed from information someone might know or gather about you or a password that has a meaning. You must never allow anyone to access your Account or watch you accessing your Account. You must comply with the security procedures we tell you about from time to time.

If at any time your identification code or password is or you suspect that it has been compromised you MUST contact the company immediately.

The Customer shall notify the Company in the event that it becomes aware or reasonably believes that its servants and or agents or any third party has acted in breach of these terms and must take positive measures to prevent the continuing breach.

In compliance with legal requirement, regulation, code of conduct or any other similar requirement of a relevant professional body or authority we may ask you provide us with information and to supply documents relating to yourself and or any beneficiary.

It is a condition precedent to this agreement that such requests must not be unreasonably refused and the company will not action your instruction unless and until such time as the requested information is received.

Our obligations

The Company retains the absolute discretion to refuse any transaction from senders or to beneficiaries, including but not limited to entities and individuals on the restricted or prohibited list issued by UK authorities.

Subject to these Terms and Conditions, we agree to provide the Service to you using reasonable care. You acknowledge that the Service may not be available, in whole or in part, in certain regions, countries, or jurisdictions.

We are not obliged to process any particular Transaction. When you submit a Transaction Request, you are requesting that we process the Transaction on your behalf and consenting to the execution of the Transaction. We may, in our sole discretion, choose whether or not to accept the offer to process that Transaction. If we decide not to process the Transaction, we will notify you promptly of that decision and repay to you the Transaction Amount received by us, provided that we are not prohibited by law from doing so. If we choose to proceed with the Transaction we may still suspend or cancel it in our discretion.

We will attempt to process Transactions promptly, but any Transaction may be delayed or cancelled for a number of reasons including but not limited to: our efforts to verify your identity; to validate your Transaction instructions; to contact you; or due to variations in business hours and currency availability; or otherwise to comply with applicable law.

We may send and receive notifications in relation to Transactions by email and SMS. We will provide you with information after receipt of a Transaction Request enabling you to identify the Transaction, along with details of the amount of the Transaction in the currency used in the Transaction Request, our Service Fee, exchange rate and the date on which the Transaction Request was received.

For the purpose of the Payment Services Regulations 2017, the following fields either in totality or a subset thereof can be considered to be unique identifiers:

2. You will not access, use or attempt to use the Service to provide any Instructions unless you are at least 18 years old, and that you have the legal capacity to form a binding legal contract in any relevant jurisdiction;
3. For each Transaction Request that you submit, you will pay us the Service Fee in addition to the Transaction Amount. Payment becomes due at the time that you submit your Transaction Request. To the maximum extent permitted by law, the Service Fee is non-refundable unless expressly stated in these Terms and Conditions. If you submit a Transaction Request that results in Globalsend Ltd becoming liable for charges including but not limited to chargeback or other fees, you agree to reimburse us for all such fees;
4. we may apply a convenience fee for processing credit cards in certain jurisdictions at our discretion;
5. You will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Service or any Instruction being conducted through the Service;

When you are using the Service under these Terms and Conditions, it is your responsibility to make sure all the details are accurate before submission. Once a Transaction Request has been received it is not normally possible to change any details of that Transaction Request. You will be given the opportunity to confirm Transaction Requests before submission and you must check the details carefully.

The total amount (the Transaction Amount, Service Fee and other applicable fees and charges) that you will be required to pay and the relevant exchange rate will be displayed clearly on the website before you are asked to confirm your Transaction and proceeding with the Transaction at this point is entirely optional.

You will only use the Service to send money to people that you know personally and not to pay for goods or services from third parties you do not know and trust. You acknowledge that GLOBALSEND LTD may refuse to process your Transaction Request where we believe you are using the Service to purchase goods or services from third parties you do not know and trust or where we believe that the Service is being used, by you or the Recipient, in furtherance of fraudulent, illegal or prohibited activities. If you choose to pay third parties for goods and services using the Service, you acknowledge that GLOBALSEND LTD has no control over, and is not responsible for, the quality, safety, legality, or delivery of such goods or services and that any such use of the Service is entirely at your own risk.

In using the Service you will comply with these Terms and Conditions as well as any applicable laws, rules or regulations. It is a breach of these Terms and Conditions to use the Service to send Transaction Amounts: (i) to a Payee who has violated the Terms and Conditions, or (ii) in connection with illegal activity including but not limited to money-laundering, fraud and the funding of terrorist organisations. If Globalsend Ltd reasonably believes you are using the Service in connection with illegal activity or for any fraudulent purpose, or are permitting a third party to do so, GLOBALSEND LTDmay report you to the appropriate legal authorities.

OUR RIGHT TO REFUSE, SUSPEND OR CANCEL

(a) GLOBALSEND LTD reasonably believes you are using the Service, or allowing it to be used, in breach of these Terms and Conditions or any applicable laws, rules or regulations.
(b) GLOBALSEND Ltd is unable to verify the identity of the Recipient.
(c) You did not comply with information requested.
(d) GLOBALSEND Ltd is unable to verify your identity.
(e) GLOBALSEND Ltd temporarily/ permanently suspend your Registration
(f) To comply with our obligations under relevant laws, we reserve the right to ask for further information or evidence relating to the purpose of a Transaction.

YOUR RIGHT TO CANCEL/ REFUNDS

(a) To the extent permitted by law, once we have received your Instruction, you do not have the automatic right to revoke it.
(b) You have any problem using the services.
(c) Clause (a) above, GLOBALSEND Ltd may, in its absolute discretion, or shall if required by law, attempt to cancel or recall your Instruction if you have informed us that you wish to revoke it. In some cases, GLOBALSEND Ltd may have initiated an irreversible request for funds to be paid out to your Payee by a Service Provider and therefore cannot guarantee cancellation will be successful. For successful revocations GLOBALSEND Ltd will normally refund your money, less any reasonable revocation, recall or tracing charges and any Service Fees already charged, within four (4) Business Days.

Payment Fee & Charges

For each transaction you make with us, you agree to pay us a service fee determined by us together with any other charges which may be applicable as listed on our website.

The list of the service fees currently applicable to a transaction is contained on our website. However these service fees may change at any time without prior notice. If a service fee changes after you have submitted a transaction to us the service fee applicable at the time you made the transaction will continue to apply.

Your transaction will be complete and will proceed once we have received full payment from you. If for any reason your transaction proceeds and we do not receive full payment from you then you agree to reimburse us for the full amount of the transaction and any fees incurred.

Information collection/restriction

UK law requires all financial institutions to assist in the fight against money laundering activities and funding of terrorism by obtaining, verifying and recording information about customers. Globalsend Ltd requires you to provide us with original identification documentation to include a passport or driving licence or other form of photographic identification and an original utility bill, banking or official document, being less than 3 months old. We reserve the right to consult other recognised sources in order to obtain information about you.

Your residential address and personal details will be verified to confirm your identity. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998. By agreeing to these Terms and Conditions you acknowledge and consent to the GlobalSend Ltd.

We reserve the right to provide information about you and your transaction to government authorities and law enforcement agencies if required by such government authorities and law enforcement agencies.

The authorities prohibit us from accepting transactions with certain countries and individuals (the government authorities may from time to time may change their requirements)

In those circumstances screening will take place of all transactions against the lists of names provided by various governments. Where any “match” is identified we are required to and we will investigate the “match” to ensure compliance with current legal requirements. Our inquiries may require us to obtain additional identification and or further relevant information, which may delay the transaction process.

There may be occasions when certain threshold levels of transactions made by you are reached (the level of which may vary from time to time). If this occurs we shall require from you other additional information either about yourself, the beneficiary, the relationship between you both and the source of funds. Again if this information is not supplied to us in a satisfactory form we will be unable to provide you our service and may terminate your account and contract with immediate effect.

We reserve the right at our discretion to refuse any transaction or to limit the amount to be transferred on any transaction. Any such refusal or limitation may be imposed on individual accounts, linked accounts, or on beneficiaries at our sole discretion. . We reserve the right at any time, and from time to time, to modify or discontinue the service (or any part thereof) with or without prior notice.

Jurisdiction & Law

We are in certain circumstance obliged under Money Laundering Regulations 2007, Proceeds of Crime Act 2002 (‘POCA’) as amended by the Serious Organised Crime and Police Act 2005 (‘SOCPA’) to make a report to the National Crime Agency (NCA) where we are suspicious that any matter or transaction in which we are instructed involves the proceeds of criminal conduct.

We may be prohibited by law from informing you or anyone else when such a report has been made, and it is possible that we may not be allowed to proceed with the transaction or matter concerned until NCA gives us permission to do so. We may not be permitted to tell you anything about any of these circumstances should they occur.

3. The nature of your complaint

In the event that you are not entirely satisfied with our complaints procedure or the determination of your complaint you are entitled to make a complaint to the Financial Ombudsman Service provided you do so within one year of becoming aware of the problem or within six months of the end of our internal complaints procedure if you are still not satisfied with the outcome. In exceptional circumstances an Ombudsman may extend these time limits. This client MUST deal with the company FIRST and only if there is continuing dissatisfaction are they able to escalate matters to the ombudsman.

Intellectual Property Rights

The Website and the Application, the content, the name GlobalSend Ltd names, logos, signs, domain names, email addresses and other indications of origin displayed on the Website or the Application relating to our products and/or services and all intellectual property relating to them and contained in them (including but not limited to copyrights, patents, database rights, design right, trademarks,) Application shall remain our property and/or the property of such other third parties.
